Welcome to Higher Standard, LLC (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website (www.higherstandardhomecare.com), mobile applications, and in-home care services (collectively, the “Services”). By using our Services, you agree to comply with these Terms. If you do not agree, please do not use our Services.

1. Eligibility

  • You must be at least 18 years old to book or manage care services.
  • By using our Services, you confirm that all provided information is accurate and complete.

2. Services Provided

Higher Standard offers in-home, on-demand caregiving services for seniors, children, and individuals with disabilities in the Phoenix metropolitan area.

  • All caregivers are background-checked, trained, and experienced.
  • Services are billed at a minimum of 8-hours, with payment required in advance.
  • We reserve the right to refuse, modify or discontinue services at any time, for any reason or for no reason.

3. User Responsibilities

  • Provide accurate and up-to-date information about care needs.
  • Treat caregivers with respect and professionalism; any misconduct, as determined by Us, may result in service termination.
  • Ensure a safe environment for caregivers (e.g., no illegal activities, hazards, or abusive behavior).

4. Payments & Cancellations

  • Payment is processed upon booking, with an 8-hour minimum purchase.
  • Cancellations: Must be made, in writing via email or via phone text message, at least 72 hours in advance for refunds/credits (exceptions for emergencies).
  • No-shows or late cancellations may incur fees.

5. Intellectual Property

  • All content (logos, text, graphics) on our website is owned by Higher Standard, LLC and protected by copyright laws.
  • You may not reproduce, modify, or distribute our content without permission.

6. Disclaimers & Limitations of Liability

  • While we vet caregivers, Higher Standard, LLC is not liable for incidents outside our reasonable control (e.g., accidents, caregiver-client disputes).
  • Services are provided “as is” without warranties (express or implied).
  • Maximum liability is limited to the amount paid for services in the past 30 days.

7. Termination

We may suspend or terminate access to our Services if you violate these Terms or engage in harmful/fraudulent activities.

8. Dispute Resolution

  • Any disputes will first be resolved through good-faith negotiation.
  • If unresolved, disputes will be settled via binding arbitration in Phoenix, Arizona (waiving jury trials or class actions).

9. Governing Law

These Terms are governed by Arizona state laws, regardless of conflict-of-law principles.

10. Changes to Terms

We may update these Terms periodically. Continued use of Services after changes constitutes acceptance.
